Too many people die without making a Will, leaving the law to decide who deals with administering the Estate and who inherits it. This may well mean people who you would have liked to have left something to will miss out, whilst others who you may have wanted to have a limited claim (or possibly none at all) will take more of the estate than you would really have wanted.

In addition, if you do not make a Will and do not seek expert advice on areas directly related to death, then for example your Estate could pay more inheritance tax than may have been really necessary with professional advice. Current inheritance tax limits mean that the first £325,000 of an Estate is tax free and any amount above this limit is taxed at 40%.

Planning for events during your lifetime, such as loss of mental capacity, are as equally important as planning what happens to your property after death. For example you may want to consider making a Lasting Power of Attorney to avoid the risk of a family member having to make an application to the Court of Protection should you lose mental capacity during your lifetime – this will be expensive and lengthy and can add additional stress to an already difficult situation.
